Who Needs a Licence to Deal in Crypto in Kazakhstan

The obligation attaches to activities rather than to assets. Which activities, who they bind, and where the boundary is unclear.

Authorisation requirements in this field attach to conduct, not to ownership. Holding an asset is not a regulated activity anywhere; doing certain things with other people’s assets is.

The activities that generally require authorisation

Exchanging crypto assets for money or for other crypto assets, as a business. Holding or administering assets on behalf of others. Operating a trading platform. And transferring assets on behalf of a client.

In plain terms: if you handle other people’s assets or match other people’s trades, authorisation is in question.

Who this binds

Entities carrying on the activity by way of business in or from the jurisdiction. Individuals transacting for themselves are not within scope on that basis alone.

The by way of business test is where most boundary questions arise.

Where the boundary is genuinely unclear

Occasional peer-to-peer trading at scale. Whether a person who trades frequently for themselves, with others, crosses into carrying on a business is a question of fact and degree, and it has not been authoritatively settled for every pattern.

Anyone near that line should take advice rather than rely on a general reading.

The two regimes

Kazakhstan has a general framework and a separate regime applying within the Astana International Financial Centre, administered by its own authority.

Which applies depends on where the activity is conducted and how the entity is established. They are not interchangeable and a permission under one is not a permission under the other.

What authorisation brings with it

Customer due diligence, record keeping, reporting, capital requirements, and supervision. The licence is the entry point to a set of continuing obligations rather than a certificate.

What it means for a customer

That the counterparty is identifiable, supervised, and subject to rules about client assets. A licensed exchange under a named supervisor can be verified on a register.

What to verify before dealing with any platform

The legal entity, the authority that licensed it, the permissions held, and any conditions attached.

Four items, all public. Collect & Exchange publishes its entity and framework, and a venue whose onboarding matches what the rules ask for is usually the quickest confirmation that the obligations are being met in practice rather than claimed.
