Which Rules Apply Inside the AIFC and Which Outside

Two regimes operate in the same country. What determines which one applies to an entity or a transaction.

Kazakhstan has a general legal framework and a separate regime within the Astana International Financial Centre. They are not variants of each other.

What the AIFC is

A designated financial centre with its own legal framework, its own court, and its own financial regulator. It was established to operate on principles familiar to international financial markets.

Entities established within it are subject to its rules rather than to the general framework for the activities it covers.

What determines which applies

Where the entity is established and registered, and where the activity is carried on. An entity registered in the centre and operating under its permissions is inside.

A company elsewhere in the country is not inside merely because it deals with an entity that is.

Why two regimes exist

Because a financial centre aimed at international participants needs rules those participants recognise. Building that inside the general framework would have required changing it for everyone.

This pattern exists in several countries and produces the same question everywhere.

What differs in practice

The authorisation process, the rulebook, the supervisor, and the dispute resolution forum. For a customer, the most visible difference is which authority to approach with a complaint.

What does not differ

Anti-money-laundering obligations in substance, sanctions obligations, and the expectations of correspondent banks. These apply across both because they come from international standards and from banking relationships.

The question customers should ask

Which entity am I contracting with, where is it registered, and which authority supervises it.

A platform may operate several entities. The one on your agreement is the one that matters.

Where confusion arises

Marketing that references the centre without the contracting entity being established there. The association is implied rather than stated.

Reading the terms for the entity name resolves it in a minute.

What to verify

Entity, registration, regulator, permissions. A licensed exchange under a named supervisor states all four without being asked.

Collect & Exchange publishes the framework it operates under, and a venue whose onboarding matches what the rules ask for is one where the entity on the agreement matches the one in the marketing.
